These Terms of Service (“Terms”) govern your access to and use of the Hidden Atlas website, online store, products, content, and related services (collectively, the “Services”).

The Services are operated by Hidden Atlas / Mateusz Bąk, Racławicka 29A/22, 02-601 Warszawa, Poland (“Hidden Atlas”, “we”, “us”, or “our”).

Our online store is powered by Shopify.

By accessing our website, using our Services, or purchasing a product from us, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

1. Online Store Terms

You may use the Services only for lawful purposes and in accordance with these Terms.

You must provide current, complete, and accurate information when placing an order.

You may not use our products, website, content, or Services for any unlawful or unauthorized purpose or in violation of applicable laws or regulations.

2. Products

Hidden Atlas sells physical art prints and related products, including made-to-order products produced and fulfilled with the assistance of third-party production and fulfillment partners.

We make reasonable efforts to display products, dimensions, frame options, materials, and other product characteristics accurately.

However, colors displayed on a screen may vary from the appearance of the physical product due to differences in displays, lighting, materials, printing processes, and other factors.

Minor variations inherent to printing, framing, production, or materials do not necessarily constitute a defect.

3. Product Images and Mockups

Some product images may be digital mockups or visualizations intended to demonstrate how an artwork may appear in an interior or frame.

Mockups are illustrative and may not represent the exact physical scale, lighting, surroundings, or appearance of the delivered product.

Product specifications and dimensions stated on the relevant product page should be used when determining the actual size and characteristics of a product.

4. Orders

Submitting an order constitutes an offer to purchase the products included in the order.

We reserve the right to accept, reject, or cancel an order where reasonably necessary, including in cases involving:

• incorrect pricing or product information;

• suspected fraud or unauthorized transactions;

• payment failure;

• product or fulfillment unavailability;

• technical errors;

• shipping restrictions;

• other circumstances that make fulfillment impossible or unlawful.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

5. Made-to-Order Production

Many Hidden Atlas products are made to order.

Production may begin shortly after an order is placed. Because products are manufactured specifically in response to customer orders, changes or cancellations may not always be possible after production has started.

If you need to change or cancel an order, contact us as soon as possible at hiddenatlas404@gmail.com.

We cannot guarantee that a requested modification or cancellation will be possible once an order has entered production.

This provision does not limit any mandatory cancellation or withdrawal rights available under applicable consumer law.

6. Prices and Payment

Prices are displayed in the currency shown on the website or checkout.

Depending on your location and store settings, prices may be displayed in a local or converted currency.

You agree to provide accurate billing and payment information.

Payments are processed through Shopify and/or supported third-party payment providers. Hidden Atlas does not directly store complete payment card information.

Applicable taxes, shipping charges, duties, or other charges will be displayed or handled as required by applicable law and the checkout process.

7. Shipping and Delivery

Shipping options, applicable charges, and estimated delivery information are provided during checkout where available.

Production time and carrier transit time are separate stages of order fulfillment.

Delivery dates are estimates unless explicitly stated otherwise and may be affected by carrier delays, customs procedures, weather, peak periods, incorrect addresses, or circumstances outside our reasonable control.

8. Returns and Refunds

Returns, damaged products, incorrect items, and refunds are handled in accordance with our Refund Policy.

Customers should contact us before returning an item. Do not send products to our business address unless we have specifically instructed you to do so.

Nothing in our Refund Policy or these Terms limits mandatory consumer rights under applicable law.

9. European Union Consumer Rights

If you are a consumer located in the European Union, European Economic Area, or another jurisdiction providing mandatory consumer protections, you may have statutory rights in addition to those described in these Terms.

Where applicable, EU consumers generally have a statutory 14-day right of withdrawal for qualifying distance contracts, subject to applicable exceptions and conditions.

Nothing in these Terms is intended to exclude, restrict, or override rights that cannot lawfully be excluded or restricted.

10. Intellectual Property

Unless otherwise stated, the Hidden Atlas name, brand identity, artworks, illustrations, designs, graphics, product presentations, written content, photographs, videos, website content, and other original materials made available through the Services are owned by or licensed to Hidden Atlas and are protected by applicable intellectual property laws.

Purchasing a physical Hidden Atlas product does not transfer copyright or other intellectual property rights in the underlying artwork.

Products are sold for personal use unless otherwise expressly agreed in writing.

You may not reproduce, distribute, publish, sell, license, commercially exploit, modify for commercial use, or create unauthorized commercial reproductions of Hidden Atlas artwork or content without prior written permission.

11. Artificial Intelligence and Digital Production

Hidden Atlas may use digital tools, including artificial intelligence-assisted tools, as part of its research, ideation, image development, visualization, production, or creative workflow.

Final artworks and products may combine multiple creative and technical processes, including human art direction, design, editing, illustration, digital production, and other methods.

Use of such tools does not grant customers any additional rights to reproduce or commercially exploit Hidden Atlas content.

12. Third-Party Services

We use third-party services to operate our business, including ecommerce infrastructure, payment processing, production, fulfillment, shipping, analytics, and other technology services.

Your use of certain third-party services may also be subject to their respective terms and policies.

We are not responsible for third-party services to the extent permitted by applicable law, except where responsibility cannot legally be excluded.

13. Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce infrastructure that enables us to offer products and Services to you. Purchases made through the Hidden Atlas store are transactions between you and Hidden Atlas, not between you and Shopify.

Shopify may process information relating to your use of the Services as described in applicable Shopify terms and privacy documentation.

14. Privacy

Your submission and our processing of personal information through the Services are governed by our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by Shopify and other service providers where necessary to operate the store, process payments, fulfill orders, provide customer service, and perform other legitimate business functions.

15. Reviews, Feedback and Submissions

If you voluntarily submit reviews, feedback, suggestions, photographs, or other content to us, you confirm that you have the right to provide that content.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and publish that content where reasonably necessary to operate, improve, or promote Hidden Atlas, unless prohibited by applicable law.

You must not submit unlawful, infringing, misleading, abusive, or malicious content.

16. Errors and Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, availability, or other information.

We may correct errors and update information where appropriate.

If an error materially affects an order that you have already placed, we will handle the situation in accordance with applicable consumer law.

17. Prohibited Uses

You may not use the Services to:

• violate applicable law;

• infringe intellectual property or other legal rights;

• distribute malware or malicious code;

• interfere with the security or operation of the Services;

• attempt unauthorized access to systems or data;

• engage in fraudulent activity;

• collect personal information unlawfully;

• impersonate another person or entity;

• use automated systems in a manner that materially disrupts or abuses the Services.

18. Availability of the Services

We may modify, suspend, or discontinue parts of the Services where reasonably necessary.

We do not guarantee that the website will always be uninterrupted, error-free, or available.

We may update products, content, functionality, pricing, or other aspects of the Services from time to time.

19. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, the Services and website content are provided without guarantees beyond those expressly provided by us or required by law.

Hidden Atlas is not responsible for indirect or consequential losses arising from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful, including mandatory consumer rights.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising directly from your unlawful use of the Services or your material violation of these Terms.

This section does not apply where such responsibility cannot lawfully be imposed on a consumer.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies expressly incorporated into them, constitute the agreement governing your use of the Services and purchases from Hidden Atlas, subject to mandatory applicable law.

23. Governing Law

These Terms are governed by the laws applicable to Hidden Atlas at its place of establishment in Poland, without depriving consumers of mandatory protections available under the laws applicable to them.

Nothing in this section restricts any jurisdictional rights that consumers have under mandatory applicable law.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other circumstances.

The current version will be published on this page with the date of the latest update.

Changes will apply as permitted by applicable law.
